Cllr Anita Jones - 0:00:00
committee. As chair of this committee I'd like to make a statement for the benefit of all councillors present at this meeting and for members of the public.
The applications before you tonight and indeed any applications you consider in
future must be considered on planning merits only. It is essential that members
adhere to this principle and ensure that their decisions tonight are based on the
papers before you and any information provided to during this meeting. This is
not the forum to discuss any ancillary issues relating to the planning applications before
Microphone B - 0:00:43
you. So moving on, we will start with apologies for absence. Thank you, Chair. Yes, we've 1 Apologies for Absence
Cllr Anita Jones - 0:00:48
received apologies from Councillors Mead and Fuller. Thank you. And do we have any declarations 2 Declarations of Interest
of interest? Nope. So we'll move on to approving the minutes of the meeting held on the 8th
the minutes.
3 Minutes
And then moving on to the minutes of the Licencing Act
subcommittee, which met on the 10th of September, 2026.
4 Minutes of the Licensing Act Sub-Committee
And are we happy to approve those minutes?
Thank you.
So we've got in front of you a number of planning applications.
and we're going to be starting,
we're on the white sheet tonight,
so please don't go on the green sheet.
We're gonna start with 261113FH,
Foulker, 4866 Sandgate Road, Folkestone, CT21DW.
And we've got an update.
6 26/1113/FH - Folca, 48-66, Sandgate Road, Folkestone, CT20 1DW
Folkestone & Hythe Officer - 0:01:51
Thank you, Chair, and good evening, members. The update for this application
is that an additional representation has been received
since the report was published.
Whilst this representation raises concerns
about inaccuracies in the submitted Heritage
Statements account of the building's history,
the comments support the application
and welcome the heritage -led approach
and the reuse of the building.
Thank you.
Thank you.
Cllr Anita Jones - 0:02:18
So we have one speaker this evening. The agent is speaking in support of the application.
So when you're ready, if you'd like to come forward,
and you'll have three minutes to present to us.
Thank you.
Good evening.
My name is Alistair Cross, design director at ARKvelop,
Microphone Forty - 0:02:42
the applicant architect for FOLKA1. Some of you may remember me speaking at the committee
earlier this year when prior approval was granted
for the conversion of part of FOLKA1
into 17 residential dwellings.
At that meeting, I explained that this was only the first part of the Y Division and
that we intended to follow with proposals for careful restoration and architectural
enhancements for FOLKA 1.
This application delivers on that commitment.
FOLKA 1 is an important asset within the Foulston Town Centre, which now stood largely vacant
for six years.
Our approach is not fundamentally to change its architecture, but to repair, restore,
and sensitively adapt it for its next chapter of life.
The principal elevations on Sandgate Road and Bovary Place elevations retain their established
architectural character, commercial use with upper floor windows, sensitively restored
while improving thermal and acoustic performance.
Importantly, we propose to reinstate the historic corner entrance at Sandgate Road and Bovary
Place, remove the latter intervention and restore the much stronger entrance on this
prominent corner.
The existing stained glass windows to Albion Muse will also be retained and
restored alongside careful considered improvements to the commercial
frontages and windows. At ground floor level the commercial uses are
retained and improved extending the commercial frontage around Albion Muse
Road which will bring activity and natural surveillance to what is
currently a largely blank elevation. This is complemented with further wayfinding
signage on the corner of Falcon 1 and a space dedicated for a mural that will be
made available for local artists to take on and add to the building's history.
For Art Relop, this is ultimately an exercise in adaptive reuse.
We're investing in what is already here, retaining its existing fabric, restoring its architectural
character, and establishing a viable long -term future.
The residential approval earlier this year established the principle of bringing people
back into the upper floors.
This application is the next stage, ensuring the exterior receives the same level of care
and investment. We believe these works will allow FOCA1 to once again become a positive
and prominent part of folks in town centre and we respectfully ask members to support this application.
Cllr Anita Jones - 0:05:01
Thank you. So members, have we got any, so Councillor Hollingsby. Cllr Jennifer Hollingsbee - 0:05:11
Yes, thank you chair. Well I think this is an excellent application. I'm very impressed with the fact that the developer is going to maintain a lot of the building and in fact like the windows, for instance,
keeping the frames and everything else, I think it's not going to, externally, it's going to look wonderful,
but it will still retain its original concept, if you like.
So I'm very happy with this and I think it's,
I think we're actually quite lucky to have a developer
who is willing to take on a building like this
and to keep it as original as possible.
So I'm very happy to move the recommendation.
Thank you.
Councillor Lockwood.
Cllr Anita Jones - 0:06:03
Thank you, Chair. I echo what Councillor Hollingsby just said.
Cllr Adrian Lockwood - 0:06:12
In my professional life as a building surveyor, I'm a huge advocate of mixed use development. This is a very sensible proposal in terms of the retail space.
We've seen how other larger spaces have been sat empty for ages, split into smaller units
and then let.
So this is a good strategy for the ground floor.
And as you know, we need more housing.
So this is for me a brilliant scheme and I'm happy to second.
Thank you.
Councillor Thomas.
Cllr Anita Jones - 0:06:45
Yeah, thank you, Chair. I'll just echo that as well.
Cllr Paul Thomas - 0:06:54
I think one of the concerns that we had when this came just before was about the lack of parking, but I think we've sailed around that buoy previously, so I don't want to raise that again.
I think either here or in the future application,
Are we satisfied that the change from 17 to 21 flats
doesn't compromise the minimum space
that each of those dwellings requires?
Thank you.
Thank you.
Folkestone & Hythe Officer - 0:07:19
We need to be careful that we don't stray into things that are part of the other application.
This is purely just for the external alterations
to the building and the new windows and things like that.
But yeah, we've covered the internal space standards in the prior approval application,
which is later on the agenda.
Councillor Goddard.
Cllr Anita Jones - 0:07:42
Thank you, Chair. Yeah, again, there's not a lot else to add.
Cllr Clive Goddard - 0:07:48
Just the three Rs tickled these, restore, restoration, and retention. I think any building that has the three Rs is worth the merits because, you know, anything
that gets restored back to its natural glory,
carries all the credit like agents just echoed.
So I'm more than happy to support this.
Thank you, Councillor Shude.
Thank you, again echo everything I think that's been said.
Cllr Rebecca Shoob - 0:08:17
Really pleased to see as well the corner bit of Albion News and the facade there sort of having more life.
And I think that will make a real difference
to that side of the building.
So yeah, very happy to support.
Thank you.
So we have a proposal.
Cllr Anita Jones - 0:08:36
We have a seconder. Anybody else like to speak?
So we are all happy to go with the officer's recommendation.
And who's in favour?
Thank you.
And that's unanimous.
Thank you.
7 26/1177/FH - Folca, 48-66, Sandgate Road, Folkestone, CT20 1DW
So we're going to move on to our second application, 261177FH, Volker, 4866, Sandgate Road, Folkestone,
CT21DW.
And we have Alistair Cross, the agent, speak again.
Thank you.
Microphone Forty - 0:09:31
This second application should be considered alongside the wider restoration proposal I've just outlined.
This application specifically considers the introduction of the roof lights only at the
upper floor level.
One of the fundamental principles of our approach has been to make the existing building work
rather than substantially extend, demolish, rebuild.
This means carefully working within the opportunities
and constraints of the existing structure.
At upper floor levels, the existing roof
provides an opportunity to introduce carefully positioned
conservation roof lights, bringing additional natural light
into the building, where requiring comparatively
little intervention to the existing fabric.
These proposed works would not be visible
for any public highway.
These roof lights represent that approach,
modest, carefully considered interventions
which improve the functionality of FOCA without materially changing its architectural character
or visibility from the street. Together with the external restoration proposals they form
another part of the coordinated strategy to bring the substantial vacant building back to
long -term use. We therefore respectfully ask members to support this application.
Thank you. So, um, Councillor Lockwood.
Cllr Anita Jones - 0:10:43
Cllr Adrian Lockwood - 0:10:49
Thank you, Chair. I'm just going to say, very clever piece of design, good solution. Happy to propose.
Councillor Thomas.
Cllr Paul Thomas - 0:11:01
Thank you. Yes, I support that as well. So again, very good. And again, 126 people consulted, no objections to any of this. So, you know, it will make a big difference to the town.
I'm happy to second. Thank you.
Anybody else like to make a comment?
Cllr Anita Jones - 0:11:14
So if we're happy with the proposal, all those in favour? And that's unanimous, thank you.
8 26/1212/FH/PA - Folca, 48-66, Sandgate Road, Folkestone, CT20 1DW
So moving on to our third application, 261212FHPA -Folker, again 4866 Sandgate Road, Folkestone, and
we have Alistair Cross to speak again. Thank you.
Microphone Forty - 0:11:48
Good evening again and finally. This is the final application that brings together the wider vision we've presented today. Members may remember that the prior approval was granted
in June for 17 residential dwellings within Volcker 1. Following that approval, ArcDevelop
has continued to develop the scheme and identified an opportunity to use the existing building
more efficiently, providing 21 better proportioned homes while maintaining the quality and principles
of the approved scheme. The external works presented earlier, including new windows and
skylights have enabled us to materially improve the proportions, quality and layouts of the
homes. Within the approved 17 unit scheme, working within the existing envelope resulted
in several oversized dwellings that did not represent
the most efficient use of the available floor space
or necessarily meet the needs of those seeking town centre
homes.
This revised application consolidates those layouts
to provide a balanced mix of good size one and two bed
homes.
It makes better use of the building,
reduces structural intervention, and provides greater range
of homes in both layout and price.
The proposal continues to comply with the relevant requirements
of Class MA.
The building has an established class E use,
is not listed, lies outside the conservation area,
and is not subject to an Article 4 restriction,
preventing its change of use.
However, it has had a heritage approach
to the building as a whole.
Every home meets or exceeds
the nationally described space standards,
providing adequate natural light.
The site is within flood zone one,
and there are no unacceptable transport
or highways impacts.
But as I said, when the previous application came before you,
FOCA 1 is about considerably more than meeting the technical requirements of Class MA.
This is about securing a realistic viable future for a substantial building which has largely
stayed vacant since Debenhams closed in 2020. FOCA 1 occupies a highly sustainable town centre
location with shops, services, employment amenities, public transport readily accessible
to future residents. More importantly its commercial role is also retained and enhanced.
Together with the applications presented today,
we are creating a genuinely mixed use scheme,
commercial activity at street level,
new homes above restored architecturally externally,
and a long -term use capable of supporting
the building's future.
The three applications work together,
the external works restore focus architectural presence,
while this application restores its long -term use
within the heart of Fobeston.
This remains the commitment we made
when the 17 unit schemes was approved,
careful and sensitive regeneration
rather than dominant overdevelopment.
We therefore respectfully ask the committee
to support the application and grant prior approval.
Thank you.
Cllr Anita Jones - 0:14:34
So again, we'll start with Councillor Hollingsby. Thank you, Chair.
Just a couple of questions.
Cllr Jennifer Hollingsbee - 0:14:41
I can't see anything mentioned about affordable housing. Is that not appropriate?
I just like to, I'm not sure about that.
And I think Councillor Thomas mentioned the space standards.
I think that the space standards were fine
with all of the flats.
But I think there were one or two
where it was almost the same, the minimum.
So I just wondered if you could comment on that, please.
Certainly.
Thank you, Councillor Linsby.
Folkestone & Hythe Officer - 0:15:19
Because this isn't an application for planning permission, it's an application for prior approval,
then there is no requirement for affordable housing.
There's no mechanism to secure that.
The use of the building from the commercial
to the residential is approved under the GPDO
rather than through the development plan.
And in accordance with the space standards,
the all units would either meet or exceed
the minimum space standards, which is what is required
within class MA.
Even if they all met, we couldn't refuse it under class A
as long as they meet or exceed it, then that's fine.
Thank you.
Can I just,
Cllr Jennifer Hollingsbee - 0:16:13
The only other thing I was thinking, or in looking at the plan,
the numbers look very intensive in terms of the spacing.
I understand, and I understand from the speaker,
that that's making the best use of the space available
and increasing the number.
Before I move approval, which I'm aiming to do,
Could you just make a comment on that for me, please?
Yes, certainly.
So this only represents an increase of four units overall,
which is not a significant amount
considering what's previously approved.
And I think it is fair to say that the previous prior
approval, because it was working within the existing
building without changing anything because it had to meet
the daylight standards within what was already there.
It did result in some slightly oddly shaped apartments,
but actually, and as the applicant said,
some of them were overly large compared to
what they were actually providing.
So, you know, I do think with the additional windows
that have already been approved,
it would actually create a slightly better arrangement.
Thank you very much. So on that basis and on the basis that the commercial units are
on the ground floor and maintained or work together with the residential accommodation,
I would be happy to move the approval.
Thank you. Councillor Polly Glateman.
Folkestone & Hythe Officer - 0:17:58
Thank you, Chair. Yeah, I read this one with interest,
because I remember when it came to us back in May,
the living accommodation particularly,
Cllr Polly Blakemore - 0:18:11
I thought that really well designed and yes, generously proportioned and I can see that from both sides.
We've had the speaker and officers talk to us about that.
A slightly, it was with a slightly heavy heart
I saw that the cut back on the commercial area
and the increase in the number of apartments
and the fact that about 10 of them are,
they are so compliant, they all meet the minimum standards,
but there seems to be quite a lot of reduction
in terms of the size and 10 of them are just meeting
or only just exceeding those standards.
So it seems like a bit of a change.
Having said that, I can see absolutely no reason not to go
with the approval recommended by officers.
So notwithstanding those changes,
but they're not materially, there's not something
that we can change our minds on.
So I'm happy to second the proposal.
Councillor Thomas.
Cllr Anita Jones - 0:19:15
Yes, thank you Chair. Having gone back and had a look at the right section
of the right planning application this time,
Cllr Paul Thomas - 0:19:23
again, I think the table is very clear and again, I think as Councillor Hargan has already said,
and as you've reiterated, they either meet
or exceed the minimum standards for each of these.
So again, I'm happy to support the proposal of this.
Thank you very much.
Thank you. Would anybody else like to? Councillor Lockwood.
Cllr Anita Jones - 0:19:44
Cllr Adrian Lockwood - 0:19:49
Thank you, Chair. I think this is a really challenging building and fair play for taking it on. And this is quite a clever piece of design all round, I think, to get to a place
where these flats will at least comply and in some cases well exceed the space requirement.
So yeah I'm happy to support this and really pleased to see it coming forward
and yeah best of luck to the developer with that. It's quite an undertaking.
Cllr Anita Jones - 0:20:27
Thank you. So if there's no more comments to make we have a proposer and a seconder and Who is in favour?
That is unanimous, thank you.
Cllr Anita Jones - 0:20:38
Thank you for joining us this evening. 5 26/0929/FH - Norrard, 8 Godwyn Road, Folkestone, CT20 2LA
We are going to move on to our fourth application which is 26 09 29
FH Norad 8 Godwin Road, Folkestone CT22LA
and we have two updates for this.
Thank you chair, good evening councillors.
Folkestone & Hythe Officer - 0:20:56
The first update that I have for you is that a further representation was received
objecting to the proposal on the grounds,
including density, impact on neighbouring community,
design and materials.
However, these matters have been considered
within the committee report before you
and do not alter the conclusions of the report.
The second update is that we have received comments
from KCC's Ecological Advice Service
since the report was published.
They have advised insufficient ecological information
has been provided to determine the application and have requested the submission of an ecological
impact assessment prior to the determination. They have confirmed that each of those ECIA
would need to include consideration of protected and notable species together with potentially
preliminary risk assessment for bats due to the demolition of the garage. Officers have
acknowledged that further ecological information is required in order to address the matters
raised by KCC Ecology.
However, it's considered these matters represent
an outstanding technical consultation,
which could be resolved prior to the issue
of any planning permission.
According to members are therefore requested
to determine the development,
whether the development is acceptable in all other aspects.
And if they conclude that it is,
delegate authority to the chief planning officer
to approve or refuse subject to resolution
of ecological matters.
And there is additional, just a correction
to the report at paragraph 7 .18.
It states that no first floor side elevation
habitable room days are proposed.
And this is incorrect, however, the rest of the paragraph
is correct and explains that the first floor rooms
are served by reflux.
Thank you.
Folkestone & Hythe Officer - 0:22:41
Good evening members, I've got a second update on this application in terms of the recommendation.
So members will be aware that the new national
The National Scheme of Delegation takes effect at the end of the month.
We've reviewed the recommendation in the report and have noted that should KCC Ecology, eventually,
or our Bora Cultural Officer raise objection, as drafted, the recommendation would require the item to be reported back to committee.
This wouldn't be possible under the National Scheme of Delegation, and as such, we're amending the recommendation.
So the recommendation as amended would give officers delegated authority to approve or refuse the application as follows.
So it would be subject to one, the submission of a tree survey and the comments of the Arbore Cultural Officer,
and two, the submission of acceptable ecological information required by KCC Ecology in respect to the presence or otherwise of protected species within the site.
and that officers would therefore be delegated to either A, grant planning permission subject
to the conditions set out in the report, and that delegated authority be given to the chief
planning officer to agree and finalise the wording of the conditions, add any other conditions
that he considers necessary, or B, refuse planning permission on the basis of the comments
of the Albora cultural officer and all those of KCC ecology. Thank you.
Thank you. So would anybody like to start? Councillor Mike bloke more.
Cllr Mike Blakemore - 0:24:15
Thank you, Chair. Yeah, that actually addresses the question I was going to raise, which was around the street tree, because having taken a stroll up Godwin Road to have a look, it
is a very narrow site and it's a large tree outside there. So to my eye, it looks kind
of touch and go as to whether you could get an entrance in there without that tree. And
I was going to ask the question because it would have been good to have had that tree
survey beforehand and then the kind of concerns of KCC ecological kind of adds
to that really but that kind of addresses the concern that because I was
going to say well what happens if the tree survey comes back and says no go
then what happens the application so I'm grateful to hear that it can be refused
on that basis so that's good to know thank you.
Aside from that it looks like a good well -designed scheme we've already talked
about. FOCA being a clever use of a building this is a clever use of a
rather narrow piece of land.
It's not really, the property won't really be visible
from the street.
I can't see how it affects the amenity of neighbours.
So I'm minded to support it,
having heard that about the tree and ecology.
Thank you.
Thank you.
Councillor Goddard.
Cllr Anita Jones - 0:25:24
Yeah, echo Councillor Blackmore. I can't see a lot wrong with this and happy to move.
Cllr Clive Goddard - 0:25:29
Councillor Thomas. Yeah, thank you, Chair. Yeah, I did have one question which was answered before the meeting.
Cllr Paul Thomas - 0:25:38
So again, the concern that I had was around the whole, the fact that the KCC ecology had not been bottomed out before this came to us. So again, on the basis of the response we've had and the amendment to the recommendation,
I'm happy to second the officer's recommendation as well. Thank you, Chair.
Would anybody else like to add anything?
Cllr Anita Jones - 0:26:03
Councillor Hollingsby? Cllr Jennifer Hollingsbee - 0:26:09
I don't think we have any alternative other than to delegate to the planning officer because as I said, the national planning delegation comes in on 31 October, so our powers will
be very limited as from then anyway.
So I think it wouldn't be sensible, should I say,
if we decided not to refuse it or not to take the recommendation
back to the head of planning.
So I'm happy to support, basically.
Thank you.
So if we're happy to take a vote on this,
Cllr Anita Jones - 0:26:55
we have a proposal and a seconder. All those in favour? And that's again unanimous. Thank you very much. And that's the last item on our agenda this evening. Thank you. Have a good evening.
