I would like to remind members that although we all have strong opinions on matters under

So members, as chair of this committee I would like to make a statement for the benefit of
all councillors present at the meeting and for members of the public.
The applications before you tonight and indeed any applications you consider in the future
must be considered on planning merits only.
It is essential that members adhere to this principle and ensure that their decisions
and what are based on the papers before you and any information provided to you during
this meeting.
This is not the forum to discuss any unsealing issues relating to the planning applications
before you.

So, moving on, we come to our first application of the evening, which is 22 -1122 -FH, which
is Little Woodland Farm, the workshop, Woodland Road in Limage, Folkestone.

Yes, we do, Chair.
Good evening, members.
With regards to this application, it came to light first thing this morning that there
has been a technical issue concerning the application 22 .1 .122 .FH.
A member of the public who commented on the application has not been notified that the
application is being reported to committee tonight.
The Council's normal procedures for dealing with these matters has therefore not been
followed.
This appears to be due to an internal systems error which we are currently in the process
of addressing.
I can confirm that the comments made on the application by the affected resident were
fully considered in the preparation of the Officer Recommendation and the error at hand
is purely administrative.
Under the circumstances, Officers would advise that Members may wish to defer consideration
of Application 22 -1122 -FH to the next available Planning and Licencing Committee meeting to
allow correct notification procedures to take place to ensure that due process is followed.
It is of course for members to decide whether to follow this advice or to proceed with the
consideration and determination of the item.
All the other items have been checked to see if they have had the same issue and we can
confirm that all are fine in this respect.

I was informed about this a little earlier today.
Due process is incredibly important when it comes to planning and it is incredibly important
that everyone who has commented is given the chance to reply on the consultations.
We have been given a choice whether to defer or to listen to the application tonight.
However, if we do not defer so that full consultation can take place, I believe we are disadvantaging
a resident.

to the proposed height of the building, however this has been fully addressed within the officer's

Thank you, Chair. I won't bang on. I can remember I was saying to our Chairman of the Council
and my leader here to my left about this site, I remember as a child, my friend lived down
I was about 5 or 6 round about 20 years ago and there was less than two walls there.
So I think it's a lovely building, fits in there well and happy to move.

I just got one question on 7 .49 on flooding.

It says the sequential test was applied
and there was a conflict with policy.
And then it says something which I've not seen before,
which says, but absence of real -world harm
means defending an appeal on the basis would be difficult.
It's not something I've seen in a report previously,
that's all, I just have something on that,

Yes, it was actually raised at the last committee meeting.
It comes from a swale decision where we've got a situation where it is in flood zone
3 but the flood risk assessment demonstrates that the site would be safe in flooding scenarios.
So the swale decision, the inspector picks up that there's no real world harm so essentially
there's no strong grounds for refusal on that basis which is how we've tried to set it out
Councillor Lockwood.

That design of this nature is quite often controversial and quite a lot of people don't like it.
It's obviously modern, striking, good use of the space.
it's got good credentials in terms of its carbon footprint and so on.
And it seems to me like a good use of the site.
But I am conscious there'll be people living nearby that will be concerned about
the fact that it's very different from buildings around it.
But we revere buildings like the Grand on the Lees in Fokesten,
but that was modern 130 years ago.
And I bet there were people near to that
that were moaning that it was so modern
and horrendous looking.
So I'm all in favour of good design.
This looks like good design to me,
and so I like it.

Yeah, I was gonna make similar points, actually.
I think whether or not you like this,

that is a very subjective thing.
It is an innovative design.
I'm sceptical, I think it says somewhere in there about it raising the quality of design
elsewhere.
I'm quite sceptical of that because I can't see there being many other properties like
this popping up in the marsh or elsewhere.
I like all of the sustainability elements to it, it's a very green building, although
you could also argue that we shouldn't be building houses of that size, we should be
building more houses of a smaller size, but I know we consider the applications that are
before us, but that would be really sustainable, would be to accommodate more people in more
rather than taking up a site with one big house like this.
But my main concern really was about flooding.
I was quite surprised, and I think we've touched on this before here about
the information we have to work with on flooding on the marsh.
And I'm a little bit concerned that in the future will we look back
and wonder why on earth we agreed to build so much on an area which is prone to flooding.
And I don't think it is just tidal flooding.
I think when the marsh came close to flooding, I think it was last year or the year before,
it was due to rainfall, it wasn't due to tidal flooding
and I think that's, I'm quite surprised
that we're not talking about that
and that's not the advice we're getting from the EA,
particularly when they are saying,
don't have any bedrooms on the ground floor,
that seems quite alarming to me
that you build in the property that you're thinking,
which it does say, 7 .38, it refers to that
and somewhere else, yes, 7 .46,
the EA require no ground floor sleeping accommodation
because of the flood risk.
The recommendation is to agree it,
so I don't think we can necessarily go against that.
But I am concerned that one day will we look back on this
and think what on earth were we thinking?

because in paragraph one we're told that
the reason this application has come to us
is because of the tree report was produced
by an FHDC officer.
That's not referred to anywhere else in the report or expanded on in any way.
And as the other Council of Labels said, the bigger issue seems to be the flooding.
So is the only reason it came to us because of that report, it wouldn't have come to us
otherwise?
And can you sort of clarify the issues that I think are there?

Yes, so it's essentially because the ARP report was written by someone internal.
We took advice from monitoring officer and essentially the course of action would be
to present it to committee to ensure there was transparency within the process.
So that's how it's arrived here today.
