who is the agent, to speak in support of the application. And, sir, you have three minutes
from when you start. Thank you very much.

Thank you, Chair. I hope I won't need three minutes. Good evening, councillors. As the
agent, I'm not used to speaking first, but I'm pleased to see that I'm not following
somebody speaking against the application this evening.
As you may be aware, the original submission to this application could not be supported
by officers and for a number of very good reasons.
That was the point I was asked to look at it afresh, which I did, and came up with a
different approach to this site.
We had discussions with the officers and there was a little bit of to and fro, and I would
like to say that the officers were very proactive and worked with us constructively and positively,
and the result is the scheme you see before they're recommending this evening.
I would like to say thank you, Mr McArdle.
It's not said often enough, but that constructive and proactive approach is warmly welcome, so thank you.
The last point I'd like to make.
As we all know, the hospitality industry is a difficult one for anybody to operate in.
This application process was started some three years ago
with the intent of putting the Levin in a, I was going to say a more sustainable position,
but actually it's just a sustainable position to be able to operate for the community.
And this application represents that hope. So I very much hope you will be able to support

Councillor Hornsby and then Councillor Cooper. Yes, thank you, Chairman. Well, it's not very
that we have an application to replace a pub.
It's usually closing it down.
And I actually welcome this report and this application.
And also the flats.
And I mean, I'm quite interested in the four distinct bays
and the architecture or whatever you call it now
on the facade and when you have an overall look at it, I think it looks very nice.
I'm also quite keen to see that the officers will be looking or getting full details of the external materials,
which I think is quite important in this particular instance.
There's a couple of items I just wanted to ask questions and see that the officers are happy with.
Is the balcony on the top floors? There are no balconies on the two flats on the top floor.
I understand the reason and I've read that and I just wanted to get confirmation that officers are happy with that.
The other thing is the parking, of course. There is a lack of parking there.
But again, I've read the report and I understand
and I would just like a comment on that.
The other thing I did notice and maybe I've got it wrong.
It's Mary in the marsh, at one point you say
that they've got an objection and then another point
in 1 .1 and then 5 .1, you say they haven't got an objection.
So just like clarification as to that,
it may be that because of the update on the planning,
That is where that is confused.
I noticed there are quite a lot of letters of support.
In fact, 66, although 20 objections.
I cannot really understand about the noise and disturbance
because I would imagine that is already happening
in terms of the existing club.
So I think that this is a welcome application
and I'd move the application.

Yes, to clarify the parish council comments,
they did initially object to the application,
that on re -consultation on the revised scheme,
they withdrew their objection.
Oops, so you're correct, that's just an error in the report.
Then with regards to both the balconies and the flats,
as set out in the report,
it was very much an on -balance decision
or recommendation on those two elements.
So the top floor flats don't have balconies,
but the majority, or all of the other flats
in the development do.
The sites in a relatively good location
for access to the beach and the local playground so officers considered that given the majority
of the units are properly catered for that's acceptable and again with the parking taking
into account the existing and proposed site circumstances and the location of the site
as set out in the report officers came to the conclusion that on balance in this instance
it was acceptable.

This park is saying that this bay actually is in need of this work and that will improve the area significantly.
It will also provide community facilities for the community and over the years that the equipment owners and the developers want to do with this premises,
They have never had any trouble and we don't anticipate any trouble in the future.
And they are actually very community minded.
So I'm more than happy to support this and I think it should be supported.

really lost about working with the officers.
And when people contact me about Clang,
whether it's a developer or an architect,
I always say, work with the team,
work with the office contact,
and I'm sure issues can be rectified.
And that's really good to hear that from a fine agent
saying, congratulate our team,
because there's not enough thanks in this world,
in our public life, unfortunately,
and especially for officers.
So I think that's brilliant,
where they've all worked together,
The credits, the applicant as well,
as well as the agent and loss,
that's what it's all about.
We've got there eventually, they're excellent.
Six, the two bedroom, the one bedroom,
the seven flats, just what that area needs
for the hopefully younger people
to start on the poverty ladder.
So credit really to everybody.
I'm glad it's here.
I'm glad hopefully people will support it
and I look forward to it being built hopefully very soon.

Yeah, I was just about the one kind of, I suppose, significant wrinkle if you like,
to call it that, and it was about the parking, wasn't it?
It wasn't quite up to what KCC, I think, suggests around about 28, and I think it's 17.
I was just thinking, working it through,
I mean there are seven that are allocated
to the flats, aren't there?
And then, so that leaves 10 for the pub, as it were.
It struck me as not very many,
particularly as presumably quite a few of those
would presumably might be staff,
although I guess some will be local,
but so they might be already taken.
On the other hand, I suppose it's a fairly,
I'm still kind of arguing both sides,
but it seems to me actually quite a lot of pubs
in urban environments don't have any parking at all, do they?
So, I mean, and it's a fairly densely populated area,
a lot of local people coming by foot.
So I would think probably that's okay.
I mean, that's your view,
so I was just kind of arguing your point, really.
But I mean, I noticed that residents
did have some concerns about that,
but it does strike me that, yeah,
it doesn't sound that many,
but actually if you take it in an urban environment,
there are lots of busses that don't have any parking at all.
So, yeah, fair enough.

Basically, you don't actually, and please no disrespect here, Councillor Spigman, we
don't have pubs and we don't encourage people to drink and drive to the pub.
And we certainly don't, so that's why we don't have, for example, car parking spaces.
However, the majority of people who live in St Mary's Bay actually walk to the Spigley's
There is overspill parking in Jefferson Lane, which is around the corner, which is people
in the intercoach, etc.
So there is plenty of parking if it is needed.

I am going to say we need more housing and this is giving us some more housing, which
which is great and it's agreed with Councillor Hollingsby
that it looks good.
And as a building surveyor by profession,
one of the things I advocate strongly,
and this has been hugely successful in Manchester,
is mixed use developments.
And the advantage of mixed use developments, of course,
is that the building is in use 24 -7,
you know, right through the night.
there's somebody there all the time.
So it's never kind of locked up, left alone.
And that's the advantage.
So yeah, I'll definitely support this
and always pleased to see more homes being built.

Holiday Bank slash public holidays to align with the premises licence granted on 19th
May 2021 which permits opening hours of 0800 to 0030 Monday to Sunday. That's what we

Because I'm totally confused because if it's later than 11 o 'clock, it shouldn't happen.
There was a lot of, we've filled the town now with residential properties and those
people are entitled to a bit of peace and quiet. Why do you need to buy drink and an
author licence after 11 o 'clock? So is it 11 or is it? What is it? Because I'm totally
confused.
Could you clarify once and for all what the application opening hours will be? Thank you.
As set out of paragraph 3 .1 of the report and in condition 4 at the end of the report,
which is proposed to be imposed should the application be permitted.
The hours that they are seeking are from 0800 to 030 Monday to Sunday.
That is totally unfair to the people who live in that town.
We are encouraging more and more residential properties to be built in our town centre.
No problem with that if that is what we need to do in order to get the housing that Adrian
Lockwood wants. No problem at all. But we do not need another licence premises opening
till silly o 'clock in the morning because the only people who are going to be drinking
at that time of the morning have already had enough. So all it's going to do is encourage
late night drinking and rowdiness, which I think is totally unfair for our police and
the residents who live in this town.

I was involved with the old High Street for a long time and we had many, many applications
came to this council, examples being 11 to 15 there, that's Kips, 7 the old High Street
and others. And you can get into a right pickle between licencing hours and planning licencing
hours, planning opening hours.
And you can, the licencing people will say,
yes, it's perfectly safe and okay for you to open
until 2 a .m., but this committee then says
you can only open until 11 .30.
And I'm not quite sure why different departments
within one council will disagree on something like that.
This application seeks to line those up so that they agree.
So for me, that makes sense.
And in the case of Severn, the old high street,
I think they've landed in the end
with planning and licence to 2 a .m.
But it took something like seven or eight years
to achieve both of those together to that time
in the face of many, many objections.
And they now have it, and as far as I know,
there's no issues there.
And like you say, you've got the Wetherspoons,
the old cigar and olive and so on.
with late licences all in that area.
So it helps the police if they're all in one place.
So I would support this.

Sorry, Chair. Just to add that, one of the ambitions of laying the 3G pitch
is to get the Hive youth team back on this pitch.
At the moment, Hyde youth play on Hightown Council's South Road pitches
because the club need the pitch in pristine condition.
So, just to re -emphasise your point,
is that with the 3G pitch, they will be able to use it more and more often.
And that's what they're hoping.
I mean, they'll have to coach them back,
because obviously South Road is an excellent pitch.
But that's the ambition.
